Our Pricing

A lot of the work completed here at Bashforth-Young Solicitor is offered on a fixed fee basis. This is usual on matters such as wills, and Lasting Powers of Attorney where the level of work is usually known as the outset of the matter.

For non-fixed fee work, we like to be as transparent as possible. We charge on an hourly rate basis of £185.00 per hour + VAT. This is usual on Probate Estate Administration matters and detailed below is an example of such work.

At the outset you will be provided with an estimate on how long is envisaged to conclude your matter. If the matter becomes prolonged, or more complex than initially envisaged then we will provide you with an updated cost estimate and our reasons for such increases before proceeding.

Fixed Fee Work

Wills

Our charges for wills, and the storage of such wills are as follows: -

  • Basic single will (one person)- £120.00 + VAT
  • Basic double will (a couple) - £200.00 + VAT

A basic will does not include Trusts, complex assets or any tax matters. Additional costs will be clearly set our prior to any work commencing. If your will is more complicated, then the costs will be higher, however this will be offered on a fixed fees once we have an idea of what your needs are and the advice required. In some cases additional fees may arise should you wish to draft a note alongside your will with instructions to your executors. All costs would be advised before proceeding.


Lasting Powers of Attorney

  • Property & Financial Affairs (one person) - £400.00 + VAT
  • Health & Welfare (one person) - £400.00 + VAT
  • Property & Financial Affairs and Health & Welfare (one person) - £500.00 + VAT
  • Property & Financial Affairs x 2 (a couple) - £600.00 + VAT
  • Health & Welfare x 2 (a couple) - £600.00 + VAT
  • Property & Financial Affairs and Health and Welfare x 2 (a couple) - £1000.00 + VAT

Registration Fee

There is a registration fee payable to the Office of Public Guardian of £82.00 per document. A reduction or exemption of this fee is sometimes available depending on your financial circumstances.


Probate Work

Obtaining the grant of probate only – fixed fee

We can help you through this difficult process by obtaining the Grant of Probate on your behalf, allowing you as Executor(s)/Administrator(s) to deal with the collection and distribution of the estate assets.

How much does this cost?

£700.00 + VAT

Additional disbursements (disbursements are costs related to your matter that are payable to third parties, such as court fees). Payment of the disbursements will be required on account.

Probate court fee of £155.00 + 50p per copy.

Swearing fee per Executor/Administrator of £7.00

As part of our fixed fee we will:

  • Provide you with a dedicated and experienced probate solicitor who will work on your matter
  • Identify the appointed Executor(s)/Administrator(s) and beneficiaries
  • Identify the type of Probate application you require, i.e. there is a will, or no will
  • Obtain the relevant information/documentation required to complete the application
  • Complete the probate application along with the relevant HMRC form
  • Draft an oath for you to swear
  • Make the application on your behalf
  • Obtain the Probate and securely send you the copies.

Obtaining the grant of probate with collection and distribution of assets – administering the estate

We can help you through this difficult process by obtaining the Grant of Probate on your behalf, and collect and distribute the estate assets.

How much does this cost?

This work is completed on an hourly rate basis. Currently the hourly rate for a solicitor is £185.00 per hour + VAT.

By way of example, where the estate is fairly straight forward it will usually take around 20-30 hours’ worth or work at the hourly rate above. The total legal fees would therefore be £3700 - £5550 + VAT and disbursements.

The exact costs will depend on the circumstances of the matter. For example, if the estate has no property and one beneficiary, then the costs will be at the lower end of the scale. Whereas if there are multiple beneficiaries, multiple assets and property, it would be towards the higher end of the scale, if not more.

We will handle the entire process for you. The above example is based upon as estate where: -

  1. There is a valid will
  2. No more than one property
  3. There are no more than 5 bank accounts
  4. There are no more than 5 beneficiaries
  5. There are no other intangible assets
  6. There are no disputes between the beneficiaries. Costs will increase with any disputes.
  7. There are no claims against the estate.
  8. No Inheritance Tax payable and there is no need to submit a full account to HMRC

If the solicitor/director is appointed as the executor of an estate a value element will be charged in addition.

Therefore, in addition to our basic charging rates our charges will also include a value element of 1% of the gross value of the estate, excluding the residence, plus ½ % of the value of the residence if it held in the sole name of the deceased and ¼ % of the value where it is held in joint names.

We take great care in providing clear details of our fees and ensure our charges are reasonable to beneficiaries and ourselves.

Additional disbursements will be payable (disbursements are costs related to your matter that are payable to third parties, such as court fees). Payment of the disbursements will be required on account.

Probate court fee of £157.00 (Original Grant plus four copies)

Swearing fee per Executor/Administrator of £7.00

Bankruptcy searches - £1 per beneficiary

London Gazette - £69.50 + VAT. - Protects against unexpected claims from unknown creditors.

Local Newspaper - £x – this varies dependent on the local newspaper. Quotes are always obtained before proceeding. Protects against unexpected claims from unknown creditors.

Potential additional costs: -

  • If there is no will or the estate consists of shareholdings there is likely to be additional costs. This can vary significantly depending on the estate and how they are needed to be dealt with. A more accurate quote can be provided once we know full information.
  • Dealing with the sale or transfer of any estate property is not included
